YouTube is getting sued – who will win?

YouTube, the leader in online video, is getting sued by Viacom, which owns MTV and Nickelodeon, for illegal use of clips and shows (which they refer to as massive intentional copyright infringement). About 160,000 unauthorised clips of Viacom's programmes can be found on YouTube's website and those clips have been viewed more than 1.5 billion times.

"Their business model, which is based on building traffic and selling advertising off of unlicensed content, is clearly illegal and is in obvious conflict with copyright laws," said Viacom in a statement.

On the other hand, a google spokesperson said that "YouTube is great for users and offers real opportunities to rights holders: the opportunity to interact with users; to promote their content to a young and growing audience; and to tap into the online advertising market."

Who do you think is going to win the suit? Do you think Viacom will win because as they said, it is an intentional copyright infringement (Remember what happened to Napster?) and should be penalised? Or are you hoping YouTube (Google) will win because you like browsing YouTube and think it is the best thing since the slice of bread?

I think this is going to be interesting.
